General Terms & Conditions

These General Terms & Conditions (hereinafter ‘Terms’) constitute a legally binding
agreement between you and Ausumnrealty (hereinafter ‘Ausumnrealty/We/Us/Company’)
regarding your use of the web application/website https://ausumnrealty.in (hereinafter
‘Site’) and any Services offered or made available by the Company, including delivery of
content via the Site or through any mobile or internet-connected device (collectively
‘Services’).
Your use of the Site and Services is governed by these Terms. By using the Site you agree to
be bound by these Terms. Please read them carefully.
I. Defined Terms – Agreement: refers to the completed application form, its attachments, and these Terms. – Ausumnrealty: refers to Ausumnrealty, the operator of the Site and Services. – Date of Commencement: is the date indicating the acceptance of the application by the
User to the Services. – Date of Termination: is the date of expiry mentioned in the notice and/or the letter of
termination and/or the date when the Services are supposed to end. – ausumnrealty.in: is defined as the internet website or mobile application of the Company. – My Subscriptions: refers to the section providing descriptions and details of the Services
availed by the User. – Registration Data: is the database of particulars and information supplied by the User on
initial application and subscription. – User / You: includes any Subscriber, Advertiser, Browser, or Visitor, individual or entity
using the Services.
- Confidential Information: means non-public proprietary or business-related information
disclosed in connection with these Terms.
II. Services – Scope: The Company provides internet-based Services including: posting property listings,
searching properties, placing ads, and other Services described on the Site. – Purchase: Services may be purchased through available payment options and are subject
to applicable policies, including subscription fees, refunds and cancellations.
III. Eligibility – Age: You represent and warrant that you are at least 18 years old and competent to enter
into a binding contract. – Minors: Minors may use the Service only under the supervision of a parent or guardian
through the guardian’s registered account. – Registration: You agree to register before uploading content or accessing certain Services
and to provide accurate personal details.
IV. Subscription Fees – Fees: Applicable subscription fees shall be as specified on ‘My Subscriptions’ page or as
notified by the Company. – Commencement: Subscription liability commences from the Date of Commencement. – Exemptions: Certain browsing or basic listing features may be exempt unless otherwise
notified.
V. Payment & Refund clause – Activation Charges: For all Services, a portion of the total order value may be treated as
activation/administration charges as described on the Site. – Pro-rata Refunds: Refunds, if provided, may be pro-rated based on the extent of service
usage and are subject to verification and documentation. – Processing Time: Refunds, where applicable, will be processed within a reasonable time as
described on the Site, subject to payment gateway and bank processes. - Invoices and Disputes: Users must pay fees per invoice; disputes must be raised promptly
but payment should be made pending resolution. – Non-refundable Items: Some in-app or special purchases may be non-refundable as
indicated at the time of purchase.
VI. Charge Back Policy – Advance Payment: Payments for Services are typically made in advance as specified on the
Site. – Non-refundable: Once subscribed, certain payments may be non-refundable; refunds if any
are at the discretion of the Company. – Set-off: Company may set off amounts paid by a User against amounts payable by the User
under any other agreement. – Refund Timelines: The Company does not guarantee timelines for refunds to User bank
accounts due to third-party processing.
VII. Cancellation – Right to Cancel: The Company reserves the right to refuse, cancel, or withhold publication
of any content without prior notice. – Non-refundable Packages: Certain premium packages may be non-refundable and non
cancellable, as indicated at purchase. – Cheque/DD Payments: For payments via cheque or DD, cancellations may be accepted only
prior to realization.
VIII. Security – Encryption: Transactions on the Site are encrypted. Payment details are handled by
authorized payment gateways (e.g., Razorpay) and are not stored by the Company. – Credentials: Users must safeguard usernames and passwords and report loss/theft
immediately. – Unauthorized Use: Users remain liable for activities under their account until notice of
unauthorized access is received by the Company. - Automated Extraction: Use of automated software to extract data is prohibited without
written consent.
IX. Obligations and Representations of User – Accuracy: User shall provide accurate, complete and correct Registration Data at
application time. – Verification: All data entered may be subject to verification by the Company. – Licenses: User shall obtain all necessary licenses, consents and approvals for use of
Services. – Taxes: Users are responsible for applicable taxes and costs incurred in using the Services. – Content Responsibility: User responsible for accuracy, reliability and genuineness of User
Data and indemnifies Company for claims arising from User data. – License to Use Data: User grants the Company a non-exclusive, worldwide, royalty-free
license to use submitted content for operations and marketing, excluding sensitive financial
data.
X. Prohibited Actions – Unauthorized Access: User shall not permit unauthorized persons to access or use the
Services or resell, sublicense, assign or exploit the Services. – Unlawful Content: Prohibited to post content that is defamatory, obscene, abusive, hateful,
or otherwise unlawful. – Malicious Activity: Uploading viruses, malware, or attempting unauthorized access is
prohibited. – Spam and Misuse: Sending unsolicited messages or spamming is prohibited. – Consequences: Violation may result in suspension, deactivation or blacklisting and
forfeiture of amounts.
XI. Intellectual Property Rights And Data Usage – Ownership: All intellectual property rights in the Site and Services remain the property of
the Company. – User Content: Content contributed by Users may be used by the Company and may be
subject to license as described. – Trademarks: Trademarks and brand elements on the Site are owned by or licensed to the
Company. – Retention: User data may be retained by the Company even after account suspension or
termination, unless otherwise agreed. – Marketing Consent: By submitting contact details, Users consent to receive
communications from the Company and its partners.
XII. Confidentiality – Obligation: Users must maintain confidentiality of non-public or proprietary information
received in connection with the Services. – Survival: Confidentiality obligations survive termination of access.
XIII. Amendments – Right to Amend: Company may amend these Terms at its discretion and post updates on
the Site. – Acceptance: Continued use of Services after amendments constitutes acceptance of such
changes.
XIV. Services Modification, Discontinuation, and Maintenance – Right to Modify: Company may add, modify, suspend or discontinue any aspect of Services
with or without notice. – Maintenance: Temporary deactivation for maintenance may occur and Company shall not
be liable for related losses.
XV. Third party links and Resources in Our Site – Links: The Site may link to third-party content and the Company is not responsible for
their practices or content. – No Endorsement: Links are for convenience and do not imply endorsement. – Third-Party Transactions: Transactions with third-party providers are solely between
User and provider. – Ads: Third-party ads are paid placements and Company is not responsible for advertiser
claims.
XVI. Termination And Suspension – User Request: User may request suspension; Company may suspend or terminate access
for breaches. – Forfeiture: Fees paid may be forfeited on termination as per the applicable policy. – Survival: Certain provisions survive termination including confidentiality and limitation of
liability.
XVII. Suspension of Services – Non-payment: Company may suspend Services if monies payable are not paid when due. – Reconnection: Reconnection may be subject to payment of dues and terms.
XVIII. Money back Policy – Eligibility: Specific money-back or satisfaction guarantees, if any, will be governed by the
specific product terms described on the Site. – Process: Claims must be initiated within timelines specified and will be subject to
verification and deduction of applicable charges. – Refund Timeline: Refund timelines will depend on payment processor and bank
procedures.
XIX. Violation of Terms – Remedies: Company may delete offending material, cancel accounts, and pursue legal
remedies for violations. – Cooperation: Company will cooperate with law enforcement and regulatory authorities
when required.
XX. Errors, Inaccuracies And Omissions – Typographical Errors: Company reserves the right to correct errors, inaccuracies, or
omissions in information or pricing. – No Obligation: Company is not obligated to update all information on the Site except as
required by law.
XXI. Disclaimer – No Warranty: Services are provided ‘as is’ without warranties of any kind; Company does
not guarantee results or accuracy. – Intermediary Role: Company operates as an intermediary under Section 2(w) of the
Information Technology Act, 2000. – Third-party Services: Company is not responsible for quality, performance or outcomes of
third-party services. – Limitation: Company’s total liability is limited as described in these Terms.
XXII. Limitation of Liability – No Liability: Company and its affiliates shall not be liable for direct, indirect, incidental,
punitive or consequential damages to the fullest extent permitted by law. – Cap: In any event, Company’s cumulative liability shall not exceed amounts paid by the
User related to the claim.
XXIII. Indemnity – Indemnify: User agrees to indemnify and hold harmless the Company and its personnel
from claims arising from User content or breach of these Terms.

XXV. Non-exclusive Remedy – Remedies Cumulative: Termination shall not limit either party from pursuing other
remedies available.
XXVI. Waiver – No Waiver: Failure to enforce any provision does not waive rights to enforce later. – Severability: Invalid provisions will be reformed to effect intent and remaining provisions
remain in force.
XXVII. Entire Agreement – Integration: These Terms constitute the full agreement between User and Company. – Modification: Only the Company may modify these Terms as provided herein.
XXVIII. Governing Law and Jurisdiction – Governing Law: These Terms shall be governed by the laws of India and the courts at
Bengaluru, Karnataka shall have exclusive jurisdiction. – Claims Period: Any claim must be filed within a reasonable period as specified on the Site
or shall be barred.
XXIX. Acknowledgment and Acceptance of Terms – Acceptance: By completing registration or using the Site, the User accepts and agrees to be
bound by these Terms. – Feedback: User feedback is welcomed and helps improve Services.
XXX. Privacy Policy – Reference: Our Privacy Policy is available at https://ausumnrealty.in/privacy-policy and is
incorporated by reference into these Terms. – Data Use: User information is collected and used as described in the Privacy Policy.
XXXI. Additional Disclaimers – Informational: Information on the Site is for general informational purposes and not legal,
financial or investment advice. – Verification: Users should independently verify property facts, RERA details, and other
material before acting.
XXXII. Special Offers and Third-Party Subscriptions – Third-Party Offers: Third-party subscriptions or offers are governed by their own terms
and the Company only facilitates access.
XXXIII. Legal Metrology Disclaimer – Measurements: Users must declare property area in standard units as required by
applicable law; Company may remove listings violating such requirements.
XXXIV. RERA Disclaimer – RERA Compliance: Developers and agents listing properties must comply with RERA;
Company does not verify RERA status and users must verify independently.
XXXV. Rent Agreement Disclaimer – Facilitation Only: Company acts as facilitator for rent agreements and is not a party to such
agreements; Users must undertake due diligence.
XXXVI. Home Loans – Facilitation: Company may facilitate home loan services but is not a lender and is not liable
for lender decisions.
XXXVII. HOME INTERIORS – Facilitation: Company connects users with home interior providers and is not liable for
provider performance.
XXXVIII. Site Visit – Coordination: Company coordinates site visits but does not guarantee outcomes or verify
builder claims; users bear responsibility.
XXXIX. Tenant Verification – Facilitation: Company connects users to tenant verification providers; cancellation and
refunds governed by specific product terms.
XL. Property Inspection – Facilitation: Company connects users to property inspection providers; cancellation and
refunds governed by specific product terms.
XLI. Vastu – Facilitation: Company connects users to Vastu providers and is not liable for advice or
performance.
XLII. PG Listing and PG Platform – Facilitation: Company facilitates PG listings and transactions are between users and PG
owners.
XLIII. MB Prime / Premium Services – Subscription: Premium subscription services offer additional features; fees and refund
rules apply as described on the Site.
XLIV. Legal Services – Facilitation: Company connects users to legal service providers; cancellation and refund
terms apply as per specific service.
XLV. Miscellaneous – Changes: Company reserves right to amend Terms at any time; users should review
periodically.
By using the Site and Services provided by Ausumnrealty, you acknowledge that you have
read, understood and agreed to these Terms.
